Child Support in Florida

In the state of Florida, child support is calculated by a mathematical formula that takes into account many factors, including the income of the respective parties and the amount of parenting time each parent has with the children. If you are currently paying or receiving child support, you seek a modification of a child support order.

Child support in Florida is a constitutional requirement. This means that you, as a parent, do not have the option to waive the support and a financial affidavit must be filed in every divorce, custody, paternity or any other action involving children.

If you need an attorney for a case involving the initial establishment, enforcement or modification of child support, the experienced family law attorneys at our firm can provide the assistance you need.

Spousal Support

Spousal support is one of the most hotly contested issues during, and often after divorce. In Florida, a judge may order a husband or wife to pay various types of spousal support (alimony) for the benefit of the other party. In determining whether to award either party spousal support, the judge may consider the duration of the marriage, the earning capacity of the parties, the family lifestyle during the marriage, and other factors that affect the financial security of the parties.

An award of spousal support is by no means guaranteed and judges have tremendous latitude regarding the amount and duration of any spousal support award. Accordingly, anyone who is getting a divorce should have an attorney who is very familiar with Florida's divorce and family laws.
